How it’s legal
THE PROMOTIONAL E-Kiosk authorized under the State of Illinois Criminal Code:
Kiosks are not gambling or amusement device and, therefore, they are not prohibited by Illinois state law. The sweepstakes featured on the Kiosks are more properly under the jurisdiction of the Illinois Prize and Gift Act which specifically allows for promotional sweepstakes of this kind.
The statute creates thirteen exemptions or “safe harbors.” The statute provides:
• (13) Games of skill or chance where money or other things of value can be won but no payment or purchase is required to participate.
The Kiosks provide free sweepstakes entries which are merely incidental to a purchase. The Kiosks provide for a free method of entry for the sweepstakes where no purchase is necessary at all. Because no purchase is required to participate in the game, the Kiosks are expressly lawful under the Criminal Code.
(230 ILCS 40/) Video Gaming Act:
The State of Illinois passed the Video Gaming Act (230 ILCS 40/) making Licensed Video Gaming Terminals legal in Illinois. The Video Gaming Act describes in particular which types of video gaming devices may be licensed as Video Gaming Terminals.
(230 ILCS 40/35)
The video gaming device is not used for gambling as defined under the Criminal Code, it is also not prohibited by the Video Gaming Act. Arguably, without this key clarification, several common legal activities would not be allowed in a video format. These include raffles or charitable games which utilize a video screen.
For the purposes of the Kiosks, 720 ILCS 5/28-1(b)(13) makes clear that games of skill or chance where money is won but no payment is required to participate is not considered gambling. The sweepstakes on the Kiosks, then, are not considered gambling because no payment is required to participate in the sweepstakes. Because sweepstakes are not gambling, the Video Gaming Act does not prohibit sweepstakes on video devices. Therefore, the Kiosks are legal under the Video Gaming Act.
The IGB was consulted on the amended language, was not opposed to the amendment and had an opportunity to testify at the hearings moving the amendment from committee to the floor.
Illinois sweepstakes are regulated by the Illinois Prizes and Gifts Act (815 ILCS 525/). Sweepstakes are legal under the Act’s definition of “prize.”
The Act defines “prize” as:
• a gift, award, or other item or service of value that is offered or awarded to a participant in a real or purported contest, competition, sweepstakes, scheme, plan, or other selection process that involves an element of chance.

The “sweepstakes” is a type of game of chance which awards a “prize.” Such a game is legal under the Prizes and Gifts Act as long as no purchase is necessary to participate. In that way, the Prizes and Gifts Act mirrors the Criminal Code which also allows for games of chance where money can be won but no payment or purchase is required to participate.
Connectivity:
There is no prohibition in using internet for monitoring device and data retrieving proposes is not prohibited under the Criminal Code.
Using internet for the purposes of retrieving auditing data from the Sweepstakes device does not act as an access to website that contains games of chance or skill for money.
The Company utilizes a wireless cellular connectivity for the purposes of retrieving auditing data from the Kiosk. The wireless cellular connectivity does not act as an internet site that permits a person to play a game of chance or skill.
